1. Acceptance of Terms
By accessing, registering for, or using WASurfer Connect ("the Service", "the Platform", "we", "our"), you agree to be bound by these Terms and Conditions. If you do not agree with any part of these terms, you are prohibited from using our services.
2. Description of Service
WASurfer Connect provides a software-as-a-service (SaaS) platform, including a web dashboard and API endpoints, designed to facilitate bulk WhatsApp messaging, automation, and customer communication management. We provide the infrastructure; you provide the WhatsApp account and contact lists.
3. Payment Terms & STRICT NO-REFUND POLICY
Our services are billed on a subscription basis (monthly or annually) in advance. By subscribing to a paid plan, you agree to the following unalterable payment terms:
- All Sales are Final: Due to the digital and infrastructural nature of our service, NO REFUNDS WILL BE PROVIDED under any circumstances once a payment is processed.
- No Prorated Refunds: If you cancel your subscription before the end of your current billing cycle, your account will remain active until the end of the cycle. We do not offer prorated refunds for unused time.
- Auto-Renewal: Subscriptions automatically renew unless cancelled prior to the renewal date. It is your sole responsibility to cancel your auto-pay from the dashboard if you no longer wish to use the service.
- Account Bans: As outlined in Section 5, no refunds will be issued if your WhatsApp number is banned or restricted by Meta/WhatsApp during your subscription period.
4. Acceptable Use & User Obligations
As a user of WASurfer Connect, you explicitly agree that you will NOT:
- Send unsolicited spam messages or broadcast to contacts who have not explicitly opted-in to receive communications from you.
- Use the service for illegal, fraudulent, harassing, or malicious activities.
- Send content that violates Meta's Commerce Policy or WhatsApp's Terms of Service.
- Attempt to reverse-engineer, hack, or disrupt the WASurfer Connect API or infrastructure.
Violation of these terms will result in immediate account termination without notice and without refund.
5. WhatsApp Ban Disclaimer & Limitation of Liability
WASurfer Connect provides the routing software; however, WhatsApp (Meta) strictly monitors and enforces its own anti-spam algorithms. WASurfer Connect is NOT responsible or liable for any WhatsApp account bans, number blocks, or service restrictions imposed by Meta.
In no event shall WASurfer Connect, its directors, employees, or partners be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from your access to or use of or inability to access or use the Service.
6. Account Termination
We reserve the right to suspend or terminate your account immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms. Upon termination, your right to use the Service will immediately cease.
7. Changes to Terms
We reserve the right, at our sole discretion, to modify or replace these Terms at any time. What constitutes a material change will be determined at our sole discretion. Continued use of the platform after any such changes shall constitute your consent to such changes.
